AAF to File Suit Against New York State Office of the Attorney General if Audit Records Not Released In Political Smear Operation

Washington, D.C. — American Accountability Foundation (AAF) recently made a request under the New York Freedom of Information Law, Article 6 of the Public Officers Law, which amounts to a NY state-level FOIA request. The records AAF seeks are copies of the audit log for access to Federal Taxpayer Information related to the taxpayer Stand for America, Inc.

On August 26, 2022, the newspaper Politico posted the federal return for Stand for America, Inc, the last page of which was stamped that it had been received in the NY State Office of the AG. The information was leaked to disclose the donors to Stand for America Inc. to make an argument about “dark money.” AAF seeks to root out the leaker and to ensure the NY office examines its custodial duty to prevent future leaks.

Tom Jones, founder of AAF said, AAF is committed to ensuring that the person who illegally disclosed confidential tax records is brought to justice. This story has been in the works for quite a while now, and the Attorney General of New York should have already investigated, fired, and referred for prosecution the individuals who criminally disclosed these records. If she won't do her job to root out criminal behavior in the Charity Bureau of the Attorney General's office, AAF will. We hope the Attorney General swiftly deals with the person who broke the law, but if she doesn't we are prepared to sue to hold them accountable.

AAF is hopeful that the AG’s office will produce the documents requested. Yet, if they deny the records request, AAF is prepared to file a lawsuit to get the audit records and pursue their investigation of who may have acquired the records and illegally leaked them to Politico.
